Terms of Service Last updated: May 13, 2026 Welcome to Aqua Direct. These Terms of Service ("Terms") govern your access to and use of aquadirectusa.com (the "Site") and any products or services you purchase from us. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site. 1. About Us Aqua Direct is a pool cover retailer based in Greenville, South Carolina. We are an Authorized Meyco Pool Cover Dealer — we sell genuine Meyco safety covers, replacement parts, repair patches, and related accessories. We are not the manufacturer. Eligibility You must be at least 18 years old and able to enter into a binding contract to place an order with us. By ordering, you represent that you meet these requirements and that all information you provide is accurate and complete. We currently ship within the United States only. 3. Products and Pricing We do our best to describe our products accurately, but we don't guarantee that product descriptions, images, colors, sizes, or other content on the Site are error-free. Colors may appear slightly different on different screens. All prices are in US Dollars and are subject to change without notice. The price applicable to your order is the price displayed at the time you complete checkout. Sales tax is calculated based on your shipping address and applicable law. We reserve the right to correct any pricing or product errors and to refuse or cancel any order containing an error, even after the order has been confirmed. 4. Orders and Acceptance Your order is an offer to purchase. We may accept or decline your order at our discretion, including but not limited to situations involving suspected fraud, payment issues, product unavailability, shipping restrictions, or pricing errors. Your order is accepted only when we send you an order confirmation email. If we cancel an order after charging your payment method, we will issue a refund to the original payment method. 5. Custom and Replacement Covers Custom-shape and replacement covers are made-to-order for your specific pool. Once production has started at Meyco's factory, these orders cannot be cancelled, refunded, or exchanged. You are responsible for providing accurate measurements and specifications. We may request additional information or photos before placing your order with Meyco. Lead times for custom and replacement covers are typically 2-4 weeks from the date payment clears, but Meyco's production schedule may vary. 6. Payment We accept payment through the methods displayed at checkout, including credit and debit cards, Shop Pay, Apple Pay, and Google Pay (where available). Payment is processed securely by Shopify Payments and our supported third-party processors. By providing payment information, you authorize us to charge the full order amount, including any applicable tax and shipping. For quoted custom or replacement orders sent via invoice, payment is due before production begins. 7. Shipping Most products ship from Meyco's manufacturing facility or our warehouse via standard ground carriers. Estimated shipping times are provided as a courtesy and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or other circumstances outside our control. Freight charges may apply to oversized orders. If freight is required, we will contact you with the amount before charging your payment method. Risk of loss and title for items pass to you when the carrier receives the shipment. If your order arrives damaged, notify us within 5 days of delivery with photos so we can file a carrier claim on your behalf. 8. Returns and Refunds Stock covers may be returned within 30 days of delivery if they are unused, in original packaging, and in resalable condition. Customer is responsible for return shipping. A restocking fee may apply. Custom and replacement covers are made-to-order and are not eligible for return, refund, or exchange once production has started. Replacement parts and repair patches may be returned within 15 days of delivery if unused and in original packaging. To start a return, email info@aquadirectusa.com with your order number. Refunds are issued to the original payment method within 5-10 business days after we receive and inspect the returned item. Original shipping charges are non-refundable. 9. Warranty All Meyco safety covers sold by Aqua Direct carry a 12-year manufacturer warranty against material and stitching defects under normal use. Replacement parts and accessories carry the manufacturer's standard warranty as specified on each product page. Aqua Direct files warranty claims on your behalf as an authorized dealer — you don't have to deal with Meyco directly. To start a warranty claim, email info@aquadirectusa.com with your order number, a description of the issue, and photos. The warranty does not cover: Damage caused by improper installation, misuse, or accidents Damage from animals, debris, fire, vandalism, or acts of nature Normal wear and tear, fading, or cosmetic changes Covers used outside their intended purpose Modifications made by anyone other than the manufacturer The warranty is the sole remedy for defective products. To the maximum extent allowed by law, Aqua Direct disclaims all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. 10. Pool Safety — Important Disclaimer No safety cover replaces adult supervision. Safety covers reduce risk; they do not eliminate it. Meyco safety covers sold by Aqua Direct are certified to ASTM F1346, the American National Standard for safety covers on swimming pools, spas, and hot tubs. ASTM-certified covers are designed to hold the weight specified in the standard when properly installed and maintained. You agree that: Children, pets, and untrained adults should never be allowed near a pool — covered or not — without active adult supervision. A safety cover must be properly installed, taut, and undamaged to provide its intended protection. A loose, torn, or partially installed cover is not safe. It is your responsibility to inspect the cover, hardware, and anchors before each use and after severe weather. A safety cover is one layer of a multi-layer pool safety system. You should also use barriers (fencing, gates), alarms, supervision, and CPR training where appropriate. Aqua Direct is not liable for injuries, drownings, or property damage resulting from improper installation, misuse, damaged covers, or absence of supervision. If you are not confident installing the cover yourself, hire a professional. If you have questions about safe use, contact us before installing. 11. Installation Many Meyco covers can be installed by the customer or a local pool service company. We can recommend local installers in some areas — contact us before ordering. Aqua Direct does not perform installations directly unless explicitly stated in your order. You are responsible for proper installation, anchor placement, and ensuring the cover meets all local code requirements. 12. Intellectual Property The Site, including all text, images, logos, product photography, designs, and software, is owned by Aqua Direct or licensed to us. The Meyco name, logo, and product names are trademarks of Meyco Pool Covers and used with permission. You may not copy, reproduce, modify, distribute, or create derivative works from any Site content without our prior written consent. You may take screenshots of your own order details for personal records and warranty purposes. 13. User Conduct You agree not to: Use the Site for any unlawful purpose or in violation of these Terms Attempt to gain unauthorized access to any part of the Site or our systems Use bots, scrapers, or automated tools to access the Site Submit false, misleading, or fraudulent information Harass, abuse, or threaten our staff Interfere with the Site's operation or security We may suspend or terminate your access at any time for any violation of these Terms. 14. Third-Party Links The Site may include links to third-party websites, including Meyco's website. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party site. Your use of third-party sites is at your own risk and subject to their terms. 15. Disclaimer of Warranties Except as expressly stated in Section 9 (Warranty), the Site and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. 16. Limitation of Liability To the maximum extent permitted by law, Aqua Direct, its owners, employees, suppliers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, or goodwill — arising from your use of the Site or our products, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising from these Terms or your purchase will not exceed the greater of (a) the amount you paid for the product giving rise to the claim, or (b) one hundred US dollars ($100). Some states do not allow the limitation or exclusion of certain damages; in those states, our liability is limited to the maximum extent permitted by law. 17. Indemnification You agree to indemnify and hold harmless Aqua Direct, its owners, employees, suppliers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Site or our products, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any injury, damage, or loss involving your pool, cover, or property — including injuries to others — except to the extent caused by our gross negligence or willful misconduct. 18. Governing Law These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law principles. You agree that any dispute arising from these Terms or your purchase will be resolved exclusively in the state or federal courts located in Greenville County, South Carolina, and you consent to the personal jurisdiction of those courts. 19. Dispute Resolution Before filing any legal action, you agree to first contact us at info@aquadirectusa.com and give us 30 days to attempt to resolve the issue informally. Most disputes can be resolved quickly without lawyers. 20. Changes to These Terms We may update these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you don't agree with the changes, stop using the Site. 21. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. 22. Entire Agreement These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Aqua Direct regarding the Site and your purchases, and supersede any prior agreements. 23.
